Question
Is it legal for conveyancers who aren't licensed to be dealing with property conveyancing? Am I correct in thinking they must be licensed? Thank you very much.
Answer
Thank you for your email.
The short answer is that anyone may carry out their own conveyancing; however, it is highly recommended that you choose a professional that is regulated by the relevant bodies.
A conveyancer is a term given to your conveyancing solicitor or licensed conveyancer; both of these professionals are qualified to carry out your property conveyancing. All conveyancers that practice in England and Wales are regulated by the Solicitors Regulation Authority (SRA) or the Council of Licensed Conveyancers (CLC), and are registered with the Law Society.
All the firms that quote on reallymoving.com are credit checked and their credentials are then cross referenced with the relevant governing bodies. If you have any doubts about your conveyancing solicitors then you may check their regulatory status by visiting the Law society or the CLC websites.
It is recommended that you choose a reputable and regulated solicitor rather than doing your own conveyancing, as buying a property will be the biggest transaction in most people’s lives. It will also give that extra peace of mind knowing that you are using an experienced professional who is regulated to industry standards, carries their own Professional Indemnity Insurance and has a valid complaints procedure in place.
It is an offence for a person to describe themselves as a solicitor or licensed conveyancer when they are not authorised and regulated by the appropriate authorities, and should be reported immediately.
