Are searches necessary or advisable for new build properties or when making a cash purchase for a property?
Answer
If the client is obtaining a mortgage then it is a requirement of the lender to have conveyancing searches completed on a property. The lender will not be prepared to issue a mortgage if searches are not completed.
Should the client buy a new build off-plan it is not unreasonable for the developer to charge for a search fee, but it may be in their own best interest to take charge of this themselves. A new search will identify any new plans that have been submitted or been approved subsequent to the developer’s own searches which may have been some time previous. Based on this information, the client may be able to renegotiate a lower price should their new search reveal an unexpected issue.
If the client is a cash buyer, then it is recommended that they still obtain searches as they may flag up important details which may affect their conveyancing. However, it is completely the client’s choice if they wish to and is not a necessity. We recommend speaking to your conveyancer for advise.
